The shortage of organs for transplantation by its nature prompts ethical dilemmas. For example, although there is an imperative to save human life and reduce suffering by maximising the supply of vital organs, there is an equally important obligation to ensure that the process by which we increase the supply respects the rights of all stakeholders. In a relatively unexamined practice in the USA, organs are procured from unrepresented decedents without their express consent. Unrepresented decedents have no known healthcare wishes (...) or advance care planning document; they also lack a surrogate. The Revised Uniform Anatomical Gift Act of 2006 sends a mixed message about the procurement of organs from this patient population and there are hospitals that authorise donation. In addition, in adopting the RUAGA, some states included provisions that clearly allow organ procurement from unrepresented decedents. An important unanswered question is whether this practice meets the canons of ethical permissibility. The current Brief Report presents two principled approaches to the topic as a way of highlighting some of the complexities involved. Concluding remarks offer suggestions for future research and discussion. (shrink)

Subjects and Simulations presents essays focused on suffering and sublimity, representation and subjectivity, and the relation of truth and appearance through engagement with the legacies of Jean Baudrillard and Philippe Lacoue-Labarthe.

Little attention has been given in medical ethics literature to issues relating to the truthfulness of patients. Beginning with an actual medical case, this paper first explores truth-telling by doctors and patients as related to two prominent models of the physician-patient relationship. Utilizing this discussion and the literature on the truthfulness and accuracy of the information patients convey to doctors, these models are then critically assessed. It is argued that the patient agency (patient autonomy or contractual) model is inherently and (...) seriously flawed in numerous circumstances, even those involving informed and competent adult patients. This article examines the complex relationship between culture, values, and ethics in mental health care. Cultural competence is a practical, concrete demonstration of the ethical principles of respect for persons, beneficence (doing good), nonmaleficence (not doing harm), and justice (treating people fairly)—the cornerstones of modern ethical codes for the health professions. Five clinical cases are presented to illustrate the range of ethical issues faced by mental health clinicians working in a multicultural environment, including issues of therapeutic boundaries, diagnosis, treatment choice, (...) confidentiality and informed consent, and the just distribution of limited health care resources. Individuals often describe objects in their world in terms of perceptual dimensions that span a variety of modalities; the visual (e.g., brightness: dark–bright), the auditory (e.g., loudness: quiet–loud), the gustatory (e.g., taste: sour–sweet), the tactile (e.g., hardness: soft vs. hard) and the kinaesthetic (e.g., speed: slow–fast). We ask whether individuals use perceptual dimensions to differentiate emotions from one another. Participants in two studies (one where respondents reported on abstract emotion concepts and a second where they reported on specific emotion episodes) (...) rated the extent to which features anchoring 29 perceptual dimensions (e.g., temperature, texture and taste) are associated with 8 emotions (anger, fear, sadness, guilt, contentment, gratitude, pride and excitement). Results revealed that in both studies perceptual dimensions differentiate positive from negative emotions and high arousal from low arousal emotions. They also differentiate among emotions that are similar in arousal and valence (e.g., high arousal negative emotions such as anger and fear). Specific features that anchor particular perceptual dimensions (e.g., hot vs. cold) are also differentially associated with emotions. (shrink)

The practice of paternalism has changed along with developments in medicine, philosophy, law, sociology and psychology. Physicians have learned that a patient's values are a factor in determining what is best for that patient. Modern paternalism continues to be guided by the principle that the physician decides what is best for the patient and pursues that course of action, taking into account the values and interests of the patient. In the autonomy model of the doctor-patient relationship, patient values are decisive. (...) In the paternalistic model, they are but one among several factors the physician must consider in making a medical decision. Although difficult to practise because of limitations in empathising with another person, modern paternalism remains a way to achieve maximum patient benefit. (shrink)

Asserting that humanitarian intervention is a highly ambiguous principle, Pasic and Weiss warn of the dangers of politically driven rescues that often force trade-offs between the pursuit of rescue and political order.

Under the balmy Mediterranean skies of Santa Margherita Ligure on the beautiful Italian Riviera, forty Hegelian scholars from nine countries put their heads together on the theme “Hegel’s Philosophie des subjectiven Geistes” at the Conference of the Internationale Hegel-Vereinigung, May 24–27, 1973. Enjoying the generosity of the Italian Government and the official hospitality of the Municipality of Santa Margherita, the participants heard and discussed four papers by German scholars, two each by Italians and Americans, and one each by a Dutch (...) and a French scholar. Professor Valerio Verra of the University of Rome served as host, and Professor Dieter Henrich, President of the Internationale Hegel-Vereinigung, introduced the theme of the Conference and officiated the proceedings. Chairing individual sessions and participating in the discussions were such internationally known figures as Hans-Georg Gadamer of Germany, Eric Weil and Marcel Régnier of France, W. H. Recent studies show that psychiatry residents express a relatively greater need for ethics curricula than their colleagues in other specialties. Such studies have been limited in their generalizability because they were conducted at one site. This study of 151 psychiatry residents at seven U.S. psychiatry programs aims to address that limitation. Residents were surveyed on issues pertaining to ethics and professionalism education. Participants were found to support such curricula during training and to value its relevance to the practice of psychiatry. (...) Why, despite well-established and well-publicized intergovernmental processes that date back to the early 1970s, have we been unable to put in place effective mechanisms to combat climate change? Why, despite the existence of extensive global human rights machinery, do we live in a world where mass kidnapping, rape, torture, and murder continue to blight the lives of so many? Why, despite a great deal of effort on the part of intergovernmental organizations and nonstate actors, have we been unable to make (...) much of a difference to the lives of the ultra-poor and attenuate the very worst aspects of growing global inequalities? Three new books concerning the philosophy of Hegel are scheduled to appear before the end of this year. Holt, Rinehart & Winston will publish New Studies in Hegel's Philosophy, a collection of 15 essays by Hegel scholars throughout the world, edited by Warren Steinkraus of the State University of New York at Oswego. Professor Steinkraus reports that all but two of the essays will be in print for the first time. The two exceptions are translations of articles made especially for (...) the volume. * * * The proceedings of the Wofford Symposium will be published by Martinus Nijhoff under the title Hegel and the Philosophy of Religion. The volume is edited by Darrel E. Christensen of Wofford College. * * * Presently in the press also at Martinus Nijhoff is Hegel's Critique of Aristotle's Philosophy of Mind, by Frederick G. The Executive Council pro tem of the HSA, organized during a business session of the Wofford Symposium at Spartanburg, S. C. last November, met et Vanderbilt University the following March and drafted a constitution for the Society. The members of this Council were Darrel E. Christensen of Wofford College, Robert L. Perkins of the University of South Alabama, Frederick G. Weiss, George L. Kline, Warren E. Steinkraus, Donald P. Verene, and Otho M. Adkins. Shortly thereafter the constitution was adopted (...) and an election was held. Professors Christensen, Steinkraus, Perkins, and Verene were elected President, Vice-President, Secretary, and Treasurer of the Society. * * * PURPOSE * * * The purpose of the HSA, as specified by Article II of the constitution, is "to promote the study of the philosophy of Hegel, its place within the history of thought, its relation to social, political, and cultural movements since his time, and its relevance to contemporary issues and fields of knowledge. In addition to the study of the thought and significance of Hegel, the Society has as its purpose the furtherance of original philosophical thought which has its basis in the philosophy of Hegel or which treats issues in the style, manner, or method of Hegel.". Students of Hegel will soon have at their disposal a complete translation of the Encyclopaedia of the Philosophical Sciences, "the only complete, matured, and authentic statement of Hegel's philosophical system", and the last of the four major works published by Hegel in his lifetime to be fully translated into English. Early next year, the Clarendon Press at Oxford will issue a translation of the second part of the Encyclopaedia, The Philosophy of Nature, by A.V. Miller, recent translator of Hegel's Science (...) of Logic. The translation includes the valuable Zusätze, and was supervised throughout by Professor J.N. Findlay of Yale, who has also written an Introduction for it. With it will also be published a new edition of the Philosophy of Mind, the third part of the Encyclopaedia. The text of the paragraphs is the familiar Wallace translation, but added to this volume are the Zusätze newly translated by Mr. Millet, and a new Introduction by Professor Findlay. When the present edition of the first part of the Encyclopaedia, usually referred to as "the Lesser Logic" has been exhausted, if will also be republished with some revisions and additions. Professor Findlay adds that all the proofs were done last June, and that if will appear "at a price that students will not find prohibitive". (shrink)

The present stage in the development of our society is marked by serious changes in social morality. The building of communism is entering a new stage. The man of the communist future is taking shape and being perfected before our eyes. Under these conditions, the Party - and this was emphasized at its Twenty-Fourth Congress - requires of a worker in the arts a thorough examination of contemporary life and of its hero to the full extent of his talent, and (...) demands that his ethical convictions and awareness of spirit be developed. Since this is the case, it is natural that literary criticism faces new, lofty tasks: tasks of analyzing literature in connection with those economic, societal, and moral processes which characterize social existence today. This was stated clearly both at the Party Congress and in the Resolution of the Central Committee of the CPSU "On Criticism in Literature and the Arts" [O literaturno-khudozhestvennoi kritiki]. Global Governance Futures addresses the crucial importance of thinking through the future of global governance arrangements. It considers the prospects for the governance of world order approaching the middle of the twenty-first century by exploring today's most pressing and enduring health, social, ecological, economic, and political challenges. Each of the expert contributors considers the drivers of continuity and change within systems of governance and how actors, agents, mechanisms, and resources are and could be mobilized. The aim is not merely to (...) understand state, intergovernmental, and non-state actors. It is also to draw attention to those underappreciated aspects of global governance that push understanding beyond strictures of traditional conceptualizations, and that offer better insights into the future of world order. Joseph C. Flay of The Pennsylvania State University reports that he has been working for sometime on a bibliography of works on Hegel which presently contains over 2700 items. The latest volume of the New Studies in Ethics series, Hegelian Ethics, has recently been published by St. Martin's Press, New York. The author is W. H. Walsh of the University of Edinburgh. The editor of the series, W. D. Hudson of the University of Exeter, says in his preface "Professor Walsh's monograph reintroduces Hegelian ethics to us. With great skill he redeems the vigour of Hegel's thought from the obscurities of its original expression and brings out its main lines (...) very clearly. He also rescues Hegel's view that morality is primarily a social rather than a personal phenomenon from misunderstanding. Showing Hegel's debt to, and divergences from, Kant, he presents an exposition of the former's ethic which is sympathetic but hot uncritical." THE OWL intends to review the book in the fall issue. The Executive Council of the HSA has engaged Darrel E. Christensen to serve as Chairman of a Committee for Arrangements for the symposium on "Hegel and the Sciences" being planned for December 4-6, 1970. Professor George L. Kline is serving as a member of this Committee. A third member will be announced shortly, when the site of the meeting has been determined. Persons interested in contributing to the program are invited to submit papers, proposals for papers, or indications of the (...) type of paper to which they might wish to direct a prepared commentary. The theme is construed to embrace the following four areas of investigation: Hegel's philosophies of nature and the sciences within the context of his philosophy as a hole and the thought of his time, implications of Hegel's philosophies of nature and the sciences for understanding other aspects of his philosophy, the relation of Hegel's thought and method of relating to the sciences to developments and issues in the sciences and the philosophy of science since his time, and the contributions of philosophers who in some identifiable way have practiced Hegel's method or style of doing philosophy as these relate to the sciences or to the philosophy of science since his time. The scope of the theme may be modified, et the discretion of the Committee on Arrangements, to accommodate a promising paper. The deadline for completed papers to be submitted is September 1, after which they will be mimeographed and copies sent to commentators and, a little later, to persons who register to attend the meeting. The plan is to have mimeographed copies of commentaries in the hands of authors of principal papers by early November. Papers are to be 5,000 to 12,500 words in length, but the oral presentation should not exceed 30 minutes. Commentaries and replies may run 2,000 words each, but the oral presentation should not take longer than about 12 minutes. The Hegel Society of America will retain copyright on the material presented to the Symposium, which copyright will automatically revert to the respective authors of material not placed for publication by the Committee on Arrangements of the Society by February 1, 1972. Context: Josef Mitterer has become known for criticizing the main exponents of analytic and constructivist philosophy for their blind adoption of a dualistic epistemology based on an alleged ontological difference between world and words. Judith Butler, who has developed an influential model of (de)constructivist feminism and has been labeled a linguistic constructivist, has been criticized for sustaining exactly what, according to Mitterer, most modern philosophy fails to acknowledge: namely that there is no ontological difference between objective facts beyond language and (...) the discourse about these facts. Problem: In the scholarly discussion on non-dualism, two main questions have been raised: Where does Mitterer’s basic consensus, i.e., the starting-point description, come from? and: What does it mean, to say that further descriptions change their object? Method: Comparative analysis of the core concepts of Mitterer’s and Butler’s work in the context of the history of ideas. Results: Butler’s conception of a performative production of objectivity through discursive and non-discursive iterated practices can be interpreted as an illustration of Mitterer’s claim that descriptions change their object. The problem of where Mitterer’s starting-point descriptions come from can be solved by adopting Butler’s concept of culturally inherited practices. (shrink)

The Times Literary Supplement of Thursday, June 19, 1969 reports that "Mr. A. V. Miller has Just produced a new version of the Science of Logic which is intended to replace that of the American translators Johnston and Struthers issued in 1929. It is clearly a most painstaking piece of work, and. it certainly succeeds in presenting Hegel in an idiom which is intelligible, if not exactly elegant..." The work contains a foreword by J. N. Findlay of Yale University, and (...) was recently published by Allen & Unwin in Britain. It is available in this country through the Humanities Press, New York. The extensive T. L. Part ii, "the future of hegel scholarship," by howard p. kainz. although the usual function of a bibliographical survey is to attend to what work has already been done, it would not seem inappropriate now and then for such a survey to call attention to work which still needs to be done in a certain area, i.e., to point out the existence of "gaps." the author, in attending to this admittedly subjective task, notes that in the area of hegel research (...) a) the translation of some selected works by and about hegel will contribute especially important instruments for the understanding of hegel, and should have some priority; b) efforts at the formalization of hegel's dialectical logic should be furthered; c) further inquisition into the hegelian roots of marxian and kierkegaardian positions is warranted; and d) the presentation of paradoxical hegelian content in the explicit form of paradox would be a useful complement to other prevalent modes of exposition. The Society plans to hold a symposium at least every other year as a major part of the fulfillment of its purpose. Surrogate (proxy) decision makers must make research decisions for people with dementia who lack decision-making capacity. Proxies’ decision-making processes are minimally understood. We randomly assigned 82 proxies of AD patients to informed consent for one of three hypothetical protocols with differing levels of risk and benefit. Proxies answered questions about potential benefits of the described research to the patient and society, as well as about whether they would enroll their relative and why or why not. Proxies interested in enrolling their (...) relative cited the potential for direct benefit to their relative, altruism, and trust in researchers. Those declining cited risks, inconvenience, and stage of illness. Proxies weighed numerous factors, incorporating both substituted judgment and best interests standards in their decision-making processes. Although further empirical work is needed to understand the influences on and adequacy of proxies’ decision making regarding research, these findings can help inform policy regarding surrogate consent. The dorsal anterior cingulate cortex is a key node in the human salience network. It has been ascribed motor, pain-processing and affective functions. However, the dynamics of information flow in this complex region and how it responds to inputs remain unclear and are difficult to study using non-invasive electrophysiology. The area is targeted by neurosurgery to treat neuropathic pain. During deep brain stimulation surgery, we recorded local field potentials from this region in humans during a decision-making task requiring motor output. (...) We investigated the spatial and temporal distribution of information flow within the dACC. We demonstrate the existence of a distributed network within the anterior cingulate cortex where discrete nodes demonstrate directed communication following inputs. We show that this network anticipates and responds to the valence of feedback to actions. We further show that these network dynamics adapt following learning. Our results provide evidence for the integration of learning and the response to feedback in a key cognitive region. (shrink)

Holding that the First Amendment was intended not to discourage religion but to promote religious liberty, he develops principles for the solution of problems of Church-State relations. Paul Weiss discusses the more theoretical problem of the relationship of natural and supernatural law. Natural law derives from a common good relative to a particular group, and is strictly utilitarian. Reference to a (...) supernatural or divinely given good is necessary to adjudicate between and order the differing and possibly conflicting common goods of different groups, and to provide for ethical laws that transcend utilitarian considerations. In this article, I provide Urquhart-style semilattice semantics for three connexive logics in an implication-negation language (I call these “pure theories of connexive implication”). The systems semantically characterized include the implication-negation fragment of a connexive logic of Wansing, a relevant connexive logic recently developed proof-theoretically by Francez, and an intermediate system that is novel to this article. Simple proofs of soundness and completeness are given and the semantics is used to establish various facts about the systems (e.g., that two of (...) the systems have the variable sharing property). Recent advances in the field of statistical learning have established that learners are able to track regularities of multimodal stimuli, yet it is unknown whether the statistical computations are performed on integrated representations or on separate, unimodal representations. In the present study, we investigated the ability of adults to integrate audio and visual input during statistical learning. We presented learners with a speech stream synchronized with a video of a speaker’s face. In the critical condition, the visual (e.g. /gi/) and (...) auditory (e.g. /mi/) signals were occasionally incongruent, which we predicted would produce the McGurk illusion, resulting in the perception of an audiovisual syllable (e.g. /ni/). In this way, we used the McGurk illusion to manipulate the underlying statistical structure of the speech streams, such that perception of these illusory syllables facilitated participants’ ability to segment the speech stream. Our results therefore demonstrate that participants can integrate audio and visual input to perceive the McGurk illusion during statistical learning. We interpret our findings as support for modality-interactive accounts of statistical learning. (shrink)

Conditional logics were originally developed for the purpose of modeling intuitively correct modes of reasoning involving conditional—especially counterfactual—expressions in natural language. While the debate over the logic of conditionals is as old as propositional logic, it was the development of worlds semantics for modal logic in the past century that catalyzed the rapid maturation of the field. Moreover, like modal logic, conditional logic has subsequently found a wide array of uses, from the traditional (e.g. counterfactuals) to the exotic (e.g. conditional (...) obligation). Despite the close connections between conditional and modal logic, both the technical development and philosophical exploitation of the latter has outstripped that of the former, with the result that noticeable lacunae exist in the literature on conditional logic. My dissertation addresses a number of these underdeveloped frontiers, producing new technical insights and philosophical applications. -/- I contribute to the solution of a problem posed by Priest of finding sound and complete labeled tableaux for systems of conditional logic from Lewis' V-family. To develop these tableaux, I draw on previous work on labeled tableaux for modal and conditional logic; errors and shortcomings in recent work on this problem are identified and corrected. While modal logic has by now been thoroughly studied in non-classical contexts, e.g. intuitionistic and relevant logic, the literature on conditional logic is still overwhelmingly classical. Another contribution of my dissertation is a thorough analysis of intuitionistic conditional logic, in which I utilize both algebraic and worlds semantics, and investigate how several novel embedding results might shed light on the philosophical interpretation of both intuitionistic logic and conditional logic extensions thereof. -/- My dissertation examines deontic and connexive conditional logic as well as the underappreciated history of connexive notions in the analysis of conditional obligation. The possibility of interpreting deontic modal logics in such systems (via embedding results) serves as an important theoretical guide. A philosophically motivated proscription on impossible obligations is shown to correspond to, and justify, certain (weak) connexive theses. Finally, I contribute to the intensifying debate over counterpossibles, counterfactuals with impossible antecedents, and take—in contrast to Lewis and Williamson—a non-vacuous line. Thus, in my view, a counterpossible like "If there had been a counterexample to the law of the excluded middle, Brouwer would not have been vindicated" is false, not (vacuously) true, although it has an impossible antecedent. I exploit impossible (non-normal) worlds—originally developed to model non-normal modal logics—to provide non-vacuous semantics for counterpossibles. I buttress the case for non-vacuous semantics by making recourse to both novel technical results and theoretical considerations. (shrink)

The article develops g.h. mead's social behaviorist contention that adult knowledge results not merely from testing beliefs derived from sensory perception but also from the physical and social context in which beliefs are expressed. by showing the role of language in knowledge, the actual conditions of knowledge are described rather than prescribed.

This book approaches Hegel from the standpoint of what we might call the question of knowledge. Hegel, of course, had no "theory of knowledge" in the narrow and abstract sense in which it has come to be understood since Locke and Kant. "The examination of knowledge," he holds, "can only be carried out by an act of knowledge," and "to seek to know before we know is as absurd as the wise resolution of Scholasticus, not to venture into the water (...) until he had learned to swim. " * While Hegel wrote no treatise exclusively devoted to epistemology, his entire philosophy is nonetheless a many-faceted theory of truth, and thus our title - Beyond Epistemology - is meant to suggest a return to the classical meaning and relation of the terms episteme and logos. I had originally planned to include a lengthy introduction for these essays, setting out Hegel's general view of philosophic truth. But as the papers came in, it became clear that I had chosen my contributors too well; indeed, they have all but put me out of business. In any case, it gives me great pleasure to have been able to gather this symposium of outstanding Hegel scholars, to provide for them a forum on a common theme of great importance, and especially, thanks to Arnold Miller, to have Hegel himself among them. Since its founding in 1950, the Metaphysical Society of America has remained a pluralistic community dedicated to rigorous philosophical inquiry into the most basic metaphysical questions. Background: Empirical ethics inquiry works from the notion that stakeholder perspectives are necessary for gauging the ethical acceptability of human studies and assuring that research aligns with societal expectations. Although common, studies involving different populations often entail comparisons of trends that problematize the interpretation of results. Using graphical model selection—a technique aimed at transcending limitations of conventional methods—this report presents data on the ethics of clinical research with two objectives: (1) to display the patterns of views held by ill and (...) healthy individuals in clinical research as a test of the study's original hypothesis and (2) to introduce graphical model selection as a key analytic tool for ethics research. Methods: In this institutional review board (IRB)-approved, National Institutes of Health-funded project, data were collected from 60 mentally ill and 43 physically ill clinical research protocol volunteers, 47 healthy protocol-consented participants, and 29 healthy individuals without research protocol experience. Respondents were queried on the ethical acceptability of research involving people with mental and physical illness (i.e., cancer, HIV, depression, schizophrenia, and posttraumatic stress disorder) and non-illness-related sources of vulnerability (e.g., age, class, gender, ethnicity). Using a statistical algorithm, we selected graphical models to display interrelationships among responses to questions. Results: Both mentally and physically ill protocol volunteers revealed a high degree of connectivity among ethically salient perspectives. Healthy participants, irrespective of research protocol experience, revealed patterns of views that were not highly connected. Conclusions: Between ill and healthy protocol participants, the pattern of views was vastly different. Experience with illness was tied to dense connectivity, whereas healthy individuals expressed views with sparse connections. In offering a nuanced perspective on the interrelation of ethically relevant responses, graphical model selection has the potential to bring new insights to the field of ethics. (shrink)
